These Terms of Service outline what you can expect when using this website, purchasing a product, or working with me. By accessing this website or purchasing or using any of my services, you agree to the terms outlined below.

Privacy Policy

1. Information I Collect and Why
The information I collect depends on how you interact with me and may include your name, email address, telephone number, billing information, purchase history, appointment information, communications, and information you choose to submit through contact, intake, consultation, coaching, or psychotherapy forms. The website and its service providers may also automatically collect limited technical information, such as your IP address, browser or device type, approximate location, pages visited, referring website, and interactions with the website. I collect and use information only where reasonably necessary to respond to inquiries, assess whether a service may be appropriate, schedule and provide services, process payments, deliver digital products, communicate with you, maintain required business and clinical records, operate and improve the website, comply with legal and professional responsibilities, and protect the security and integrity of my services. Please avoid sending sensitive personal or health information through a general website contact form unless it is specifically requested through an appropriate and secure process.

2. Website Visitors, Customers, and Coaching Clients
Personal information collected through ordinary website activity, newsletter subscriptions, purchases, and coaching-related administration may be processed through third-party platforms that support website hosting, ecommerce, payments, email communications, appointment scheduling, video conferencing, forms, analytics, file storage, and other business functions. These service providers receive only the information reasonably required to perform their services and handle information according to their own privacy policies and security practices. Some providers may store or process information outside Canada, which means the information may also be subject to the laws of the country where it is processed. I do not sell or rent your personal information. I may disclose information to a service provider, accountant, lawyer, insurer, technology specialist, or other professional adviser where reasonably necessary, or where disclosure is permitted or required by law.

3. Psychotherapy and Personal Health Information
Information collected in connection with psychotherapy may constitute personal health information and is handled separately from ordinary website, newsletter, customer, and coaching information. Psychotherapy information may include identifying and contact information, intake information, clinical notes, appointment records, payment records, consent forms, communications, and other information reasonably required to provide psychotherapy services. This information is collected, used, disclosed, retained, and protected in accordance with Ontario’s Personal Health Information Protection Act, applicable professional requirements, and the standards of the College of Registered Psychotherapists of Ontario. Personal health information is used for purposes connected to providing and administering psychotherapy, maintaining clinical and financial records, communicating about care, collecting payment, meeting legal and regulatory requirements, and supporting continuity of care where appropriate. Psychotherapy information will not ordinarily be disclosed without your consent unless disclosure is permitted or required by law. The circumstances in which confidentiality may be limited are explained more fully through the psychotherapy intake, informed-consent, and service-agreement process.

4. Electronic Communications and Virtual Services
Email, electronic forms, scheduling platforms, record systems, and video-conferencing services may be used to communicate with clients and provide virtual services. I take reasonable steps to select and use technology with privacy and security safeguards appropriate to the sensitivity of the information involved. Platforms used for psychotherapy are selected and configured with healthcare privacy, confidentiality, and security in mind. Some providers may describe their services as supporting HIPAA requirements or other healthcare privacy standards. However, psychotherapy services are primarily governed by applicable Canadian and Ontario privacy law and CRPO requirements. Although reasonable precautions are used, no email, website, video platform, electronic transmission, or storage system can be guaranteed to be completely secure. Clients are encouraged to use a private location, secure internet connection, password-protected device, and an email account that others cannot access when participating in virtual psychotherapy or coaching. Email and website forms should not be used for emergencies or urgent clinical concerns. Virtual services and electronic messages may not be monitored continuously.

5. Payments, Email Communications, Cookies, and Analytics
Payments may be processed through third-party payment providers. These providers may collect billing information, payment-card information, and transaction details necessary to complete a purchase. I generally receive confirmation of the transaction and limited billing information rather than your complete payment-card number. When you subscribe to an email list or otherwise provide consent, I may send newsletters, educational content, business updates, product information, or promotional messages. You may unsubscribe from marketing communications at any time by using the unsubscribe link included in the email. You may still receive necessary administrative or transactional messages relating to an inquiry, purchase, appointment, or active service. The website may use cookies, analytics tools, pixels, and similar technologies to operate correctly, remember preferences, understand website traffic, improve performance, and evaluate how visitors interact with the site. You can manage cookies through your browser or available website cookie controls, although disabling certain cookies may affect how the website functions.

6. Consent, Access, and Correction
By voluntarily providing personal information, you consent to its collection, use, and disclosure for the purposes explained at the time it is collected and as described in this Privacy Policy. You may withdraw consent to certain uses by contacting me, subject to legal, contractual, clinical-record, insurance, tax, and professional requirements. Withdrawing consent may affect my ability to provide a product or service. You may request access to personal information or personal health information held about you and may request that inaccurate or incomplete information be corrected. Access may be limited in circumstances permitted or required by law, including where the record contains information about another person or is protected by legal privilege. I may need to verify your identity before responding and may charge a reasonable fee where legally permitted.

7. Retention, Security, and Privacy Incidents
Information is retained only for as long as reasonably necessary to provide services, fulfil the purposes for which it was collected, and meet legal, tax, accounting, insurance, contractual, clinical-record, and professional obligations. Different retention periods may apply to website information, purchase records, coaching records, and psychotherapy records. Reasonable administrative, technical, and physical safeguards are used based on the sensitivity of the information. These may include restricted access, strong passwords, secure accounts, reputable service providers, encrypted or protected platforms where appropriate, and separation of clinical information from ordinary website and marketing information. If a privacy or security incident occurs, I will take reasonable steps to contain and investigate it, document what occurred, reduce the risk of further harm, and notify affected individuals, regulatory bodies, or other authorities where required.

This Privacy Policy may be updated periodically to reflect changes in my services, technology, service providers, professional requirements, or legal obligations. This website, its digital products, email communications, and contact forms are not designed or monitored for emergencies or crisis support. If you are experiencing an emergency, believe that you may harm yourself or another person, or believe that someone is in immediate danger, contact 911, local emergency services, or an appropriate crisis service.
 

3. Personal Responsibility, Results, and Third-Party Resources

You are responsible for evaluating the information provided and deciding whether and how to apply it. Any actions you take based on this website, its content, or its digital products are taken at your own discretion and responsibility. Personal growth, mindset work, habit change, goal achievement, and other outcomes vary from person to person, and no particular result is promised or guaranteed. Testimonials, examples, stories, and descriptions of possible benefits reflect individual circumstances and should not be interpreted as typical or guaranteed results. This website may also reference or link to third-party websites, books, tools, products, professionals, or other resources. These Terms of Service apply to your use of jenineshaw.com, including its pages, blog posts, newsletters, resources, digital products, eBooks, coaching services, therapy services and any other content, products, or services made available through this website. Throughout these terms, “I,” “me,” and “my” refer to Jenine Shaw. “You” and “your” refer to any visitor, subscriber, customer, purchaser, or coaching client using this website or its related products and services. By accessing this website, submitting information, purchasing a product, or engaging my services, you confirm that you have read, understood, and agreed to these terms. If you do not agree with these terms, please do not use this website or purchase its products or services.

 

2. Eligibility and Appropriate Use

You must be at least the age of majority in your province or territory of residence to purchase products or coaching services through this website. You agree to use this website, its content, products, and services only for lawful purposes. You may not use the website in a way that could damage, disable, interfere with, or compromise its operation, security, or availability. You may not attempt to gain unauthorized access to any area of the website, customer account, payment system, digital product, or other system connected to this website.

 

3. Educational and Informational Purposes

The information provided through this website, blog posts, newsletters, eBooks, workbooks, digital products, social media content, and other resources is provided for general educational and informational purposes only. This content does not constitute psychotherapy, counselling, medical advice, mental-health treatment, diagnosis, legal advice, financial advice, or any other individualized professional service. It should not be used as a substitute for advice or care from a qualified professional who is familiar with your individual circumstances. Accessing this website, reading its content, subscribing to communications, or purchasing a product does not create a coach-client, psychotherapist-client, or other professional relationship with Jenine Shaw. You are responsible for using your own judgment when deciding whether and how to apply any information provided.

4. Coaching Is Not Psychotherapy

Life coaching and psychotherapy are separate services with different purposes, scopes, and professional relationships. Coaching is a collaborative and forward-focused service intended to support personal growth, mindset development, goal setting, decision-making, accountability, and follow-through. Coaching does not include the assessment, diagnosis, or treatment of mental-health conditions. It is not a substitute for psychotherapy, counselling, medical treatment, psychiatric care, or crisis support. Although Jenine Shaw has professional education and experience in psychotherapy, purchasing or participating in coaching does not establish a psychotherapist-client relationship. Coaching clients are not receiving psychotherapy or healthcare services. You remain responsible for determining whether coaching is appropriate for your needs. If concerns arise that fall outside the scope of coaching, you may be encouraged to seek support from a qualified medical, mental-health, legal, financial, or other appropriate professional. This website and its services are not intended to provide emergency or crisis support. If you are experiencing an emergency or believe that you or another person may be in immediate danger, contact 911, your local emergency services, or an appropriate crisis service.

5. Coaching and Psychotherapy Services

Coaching and psychotherapy are separate services. Each has its own purpose, scope, intake process, informed-consent requirements, policies, and professional relationship. Submitting an inquiry, booking a consultation, completing a form, or making a payment does not by itself establish a coaching or psychotherapy relationship

Coaching Services: A coaching relationship begins only after you have completed any required intake process, agreed to the applicable coaching agreement, and received confirmation that coaching services will begin. The coaching agreement may outline additional terms relating to session frequency, scheduling, payments, cancellations, communication between sessions, confidentiality, termination, and the responsibilities of each party. Coaching is a collaborative process. You remain responsible for your own decisions, actions, participation, and results.

 

Psychotherapy Services: A psychotherapy relationship begins only after you have completed the applicable intake and informed-consent process, agreed to the psychotherapy service agreement and relevant practice policies, and received confirmation that psychotherapy services will begin. Psychotherapy services are provided in accordance with applicable laws, professional standards, and regulatory requirements. The psychotherapy agreement and informed-consent materials may address matters including the nature and scope of services, fees, scheduling, cancellations, privacy, confidentiality and its legal limits, recordkeeping, communication, emergency procedures, and termination of services. Psychotherapy is not appropriate for every person or circumstance. Where your needs fall outside the therapist’s competence, scope of practice, service format, or ability to provide appropriate care, you may be referred to another qualified professional or service.
 

Additional Service Agreements: The specific agreement and informed-consent documents applicable to the service you receive form part of the terms governing that professional relationship. If a separate coaching or psychotherapy agreement conflicts with these general Terms of Service, the service-specific agreement will govern matters directly related to that service.

6. No Guarantees
I aim to provide thoughtful, ethical, and high-quality coaching, psychotherapy, content, and products. However, no particular outcome or result can be promised or guaranteed. The results of coaching and psychotherapy vary from person to person and may be affected by many factors, including your individual needs, circumstances, goals, participation, therapeutic or coaching fit, available supports, and events outside either party’s control. Participating in coaching or psychotherapy does not guarantee that you will achieve a particular personal, emotional, relationship, professional, financial, health, or other outcome. Testimonials, examples, client experiences, and descriptions of potential benefits are provided for illustrative purposes only. They do not represent promises or guarantees that you will experience the same or similar results.

7. Purchases and Payments

Prices for coaching services and digital products are displayed in US Dollars unless otherwise stated. Psychotherapy services are charged in Canadian dollars. By submitting payment information, you confirm that you are authorized to use the selected payment method and agree to pay all applicable charges. Payments may be processed by third-party payment providers. I do not directly store complete credit or debit card information when payments are handled through these providers. You are responsible for providing accurate billing, contact, and account information and for updating that information when necessary. Any applicable taxes, fees, or currency-conversion charges may be added to your purchase or charged by your payment provider. I reserve the right to correct pricing errors and to cancel or refuse an order where a price, product description, or other material information was displayed incorrectly. Where an order is cancelled after payment due to an error on my part, the applicable payment will be refunded.

8. Refund Policy

Except where required by applicable law, all purchases are final and non-refundable.

Digital Products: Due to the immediate-access and downloadable nature of digital products, eBooks, workbooks, templates, and other downloadable resources, refunds, returns, and exchanges are not offered once a purchase has been completed or access has been provided. You are responsible for reviewing the product description and determining whether a product is suitable for your needs before purchasing it. A refund will not ordinarily be provided because you changed your mind, did not use the product, expected different information, or experienced circumstances unrelated to the delivery or quality of the purchased product. If you experience a technical problem accessing a product, receive the wrong product, are charged incorrectly, or believe that a product was materially misrepresented, please get in contact (contact@jenineshaw.com) and I will make reasonable efforts to correct the issue.

 

Coaching Services: Payments for coaching services are non-refundable once the applicable coaching period or session has begun, except where required by law or expressly stated in a separate coaching agreement. Scheduling, cancellation, missed-session, unused-session, renewal, and termination policies will be outlined in the coaching agreement or booking information provided before services begin. Ending coaching does not automatically create a right to a refund for services already delivered, sessions missed, time reserved, or a billing period that has already begun.

Nothing in this refund policy limits any non-waivable rights or remedies available to you under applicable consumer-protection law.

 

Psychotherapy Services: Fees for psychotherapy sessions that have already taken place are non-refundable, except where required by law or where a billing error has occurred. Fees associated with missed appointments or late cancellations will be handled in accordance with the cancellation policy outlined in the psychotherapy service agreement and informed-consent documents provided before services begin. Insurance coverage, direct billing, or reimbursement by an insurance provider is not guaranteed. You remain responsible for any portion of the fee that is not covered or reimbursed by your insurer. If you believe that you were charged incorrectly, charged more than once, or billed for a service you did not receive, please contact contact@jenineshaw.com so the matter can be reviewed.

 

9. Digital Product Licence

When you purchase a digital product, you receive a limited, revocable, non-exclusive, non-transferable licence to access and use that product for your own personal and non-commercial use. Purchasing a product does not transfer ownership of the product, its content, its design, or any related intellectual-property rights to you. Unless you have received prior written permission, you may not:

  • Copy, reproduce, republish, or redistribute the product

  • Resell, sublicense, rent, or commercially exploit the product

  • Share the product, download link, login information, or files with another person

  • Upload the product to a shared drive, membership library, database, file-sharing platform, artificial-intelligence system, or public website

  • Remove copyright, trademark, attribution, or other ownership notices

  • Modify the product and present it as your own

  • Use the product to create a competing product or service

  • Use worksheets, exercises, frameworks, or teaching materials with clients, groups, students, or customers for commercial purposes

A separate licence or written authorization is required for professional, organizational, group, classroom, or commercial use. I may suspend or terminate access to a digital product if I reasonably believe that these licence terms have been violated.

 

10. Intellectual Property

Unless otherwise stated, all content available through this website is owned by or licensed to Jenine Shaw and is protected by applicable copyright, trademark, and intellectual-property laws. This includes, without limitation:

  • Website copy and page content

  • Blog posts and newsletters

  • eBooks, guides, worksheets, and digital products

  • Coaching materials and frameworks

  • Graphics, logos, branding, photographs, audio, and video

  • Course, program, product, and service names

  • Downloads, templates, exercises, and presentations

You may read and share links to publicly available website pages for personal and non-commercial purposes. You may not copy, reproduce, publish, adapt, distribute, sell, licence, scrape, or commercially use any website content without my prior written permission, except where permitted by law. Brief quotations may be used for commentary, review, or other legally permitted purposes when appropriate credit and a link to the original source are provided.

 

11. User Submissions and Communications

The level of identifying information included will be based on the permission you provide.

These terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer-protection law, disputes relating to these terms will be brought before the courts located in Ontario, Canada.

 

20. Severability

If any provision of these terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

21. No Waiver

A delay or failure to enforce any provision of these terms does not waive the right to enforce that provision or any other provision in the future.
